VacationGym Terms of Service

VacationGym is a platform designed to help users discover gyms and fitness facilities when travelling. Depending on the feature set available at any given time, VacationGym may provide:

• Gym search and maps
• External gym information sourced from third-party providers
• User reviews, photos and ratings
• Equipment and facility information
• Day pass information
• Personalised Match Scores
• Future booking services, if and when introduced

Not all features may be available at all times. Day pass booking is not currently offered as an in-platform payment service and any such functionality will be governed by additional terms if and when it is launched.

By accessing or using VacationGym, you agree to these Terms of Service. If you do not agree, you must not use the service.

To use VacationGym you must:

• Be legally capable of agreeing to these Terms
• Provide accurate information
• Use the service lawfully and in accordance with these Terms

Where minors are permitted to use the service under applicable law, appropriate parental or legal guardian consent may be required.

You are responsible for:

• Maintaining the security of your account and credentials
• Activities performed through your account
• Providing accurate and up-to-date information
• Not sharing access in ways that abuse the service

VacationGym may suspend or terminate accounts for serious or repeated violations of these Terms.

You may authenticate to VacationGym through third-party providers such as Google. Such providers operate independently and have their own terms and privacy policies. VacationGym is not responsible for the operation, availability or content of third-party services.

Gym information on VacationGym may come from:

• Google or other external providers
• Gym owners and their representatives
• VacationGym administrators
• Community users

Such information may include:

• Address and location
• Opening hours
• Equipment and facilities
• Prices and day pass information
• Photos and reviews

VacationGym aims to provide useful and accurate information but cannot guarantee that all gym information is complete, current or error-free. You should verify critical information directly with the gym where necessary, in particular opening hours, day pass availability, prices, access rules and equipment availability.

Some information shown on VacationGym is provided by external services. VacationGym maintains a clear separation between Google-sourced content, VacationGym's own data and VacationGym user-generated content. VacationGym does not claim ownership of Google Reviews or other external provider content, which remains subject to the terms of the relevant provider.

VacationGym Match Scores are informational recommendations derived from available data and your preferences. Please note:

• Match Scores are not guarantees of quality, availability or suitability.
• Results depend on the data available at the time of the search.
• Missing or outdated information may affect results.
• Any sponsored placements will be clearly identified as such and will not be presented as organic Match Scores.

You may submit content such as:

• Reviews and ratings
• Photos
• Equipment and facility information
• Corrections to listings
• Day pass information

You must only submit content that you have the right to submit. Prohibited content includes, without limitation:

• Illegal content
• Defamation, harassment or hate content
• Fraudulent or manipulated reviews
• Spam
• Content that infringes copyright or other intellectual property rights
• Content that violates privacy or applicable data protection laws
• Misleading information about a gym or the platform
• Explicit or inappropriate content unrelated to the platform

You retain ownership of the original content you submit. By submitting content to VacationGym, you grant VacationGym a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, format, moderate, distribute and promote that content within the VacationGym service and in connection with the operation, improvement and promotion of the platform and the relevant gym listings. This licence is limited to those purposes and terminates for future use if you delete the content, except to the extent it has been shared with or relied on by other users or is required for legal or security purposes.

Reviews on VacationGym must:

• Reflect genuine experiences
• Be honest and fair
• Not be manipulated or coordinated
• Not be posted in exchange for undisclosed incentives

VacationGym may remove fake reviews, moderate abusive content, investigate suspicious activity and suspend accounts involved in manipulation. VacationGym Reviews are shown separately from Google Reviews and are not merged into a single combined rating.

You may only upload photos that you are legally permitted to share. You should not upload:

• Images that violate the privacy of others
• Copyrighted material without appropriate rights
• Illegal content
• Images unrelated to the relevant gym

VacationGym may moderate or remove images at its discretion.

Gym owners and authorised representatives may be permitted to claim gym profiles. Claiming a gym does not give the owner control over:

• Independent user reviews
• Platform moderation decisions
• The integrity of VacationGym rankings or Match Scores

VacationGym may require verification for gym claims. False ownership claims may result in account suspension or removal.

Listing on VacationGym does not guarantee:

• Entry to the gym
• Day pass availability
• Equipment availability
• Access at any specific time
• Acceptance of tourists or non-members
• Any specific pricing

You remain responsible for confirming access conditions directly with the gym.

VacationGym does not currently offer in-platform day pass booking or payment services. If VacationGym later offers booking, payment or similar services, additional booking and payment terms (including cancellation, refund and payout conditions) will apply and will be presented to you at that time.

You must not:

• Scrape or systematically extract data from the platform without permission
• Abuse or overload our APIs
• Attempt to gain unauthorised access to any part of the platform
• Circumvent security or access controls
• Upload malware or malicious code
• Manipulate ratings, reviews or Match Scores
• Create fake accounts or impersonate others
• Submit false gym data
• Impersonate gym owners or representatives
• Interfere with the operation of the platform or other users' access

The VacationGym brand, design, software and original platform content belong to VacationGym or its licensors. Third-party content, including content sourced from Google, remains the property of the respective rights holders and is displayed in accordance with their terms.

VacationGym may update features, change functionality, perform maintenance and suspend parts of the service. We do not guarantee uninterrupted or error-free availability.

VacationGym may suspend or terminate access to accounts for serious Terms violations, fraud, abuse, security threats or illegal activity. Where appropriate, you may contact support to discuss decisions affecting your account.

VacationGym provides information about independent gyms and fitness facilities and does not itself operate those gyms. To the extent permitted by applicable law:

• Gym information may change without notice.
• External providers may be unavailable or return incomplete data.
• VacationGym is not responsible for the internal safety, equipment condition or conduct of independent gyms or their staff.

Nothing in these Terms excludes or limits liability where exclusion or limitation would be unlawful.

To the maximum extent permitted by applicable law, and subject to your mandatory consumer rights, VacationGym and its affiliates will not be liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill, arising out of or in connection with your use of the service.

Nothing in these Terms excludes liability where exclusion is prohibited by law. Consumer statutory rights remain unaffected. Specific liability provisions may differ by jurisdiction. Any monetary caps on liability will be confirmed once the operating entity and its legal structure are finalised: see [LEGAL ENTITY NAME].

To the extent permitted by law, you agree to indemnify and hold VacationGym harmless from claims arising from your business misuse of the platform, your submission of illegal content, or serious violations of these Terms. This clause does not apply to ordinary consumer use.

These Terms are governed by the laws of the Netherlands. This does not deprive consumers of mandatory protections available under the laws of their country of residence where such protections apply.

VacationGym may update these Terms from time to time. Where changes are material, we will use reasonable means to communicate the update. The latest revision date is shown at the top of this page.
